Please read these Terms and Conditions (“Terms”) carefully before using the FPK Pass mobile application operated by FunKitchen LLC (“Company,” “we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 21 years of age to use FPK Pass and purchase a membership. FPK Pass is available exclusively to residents of the United States. By registering, you represent and warrant that:
We reserve the right to verify your age and identity and to terminate your account if we determine you do not meet eligibility requirements.
To use FPK Pass, you must create an account by providing your name, email address, date of birth, and a profile selfie. You are responsible for:
You may not create an account on behalf of another person or use false identity information. We reserve the right to suspend or terminate accounts that violate these Terms.
FPK Pass offers membership plans (including monthly plans) that grant access to in-app drink ordering and other member benefits at Fun Pizza Kitchen locations. Membership details, pricing, and benefits are described within the App.
All payments are processed securely by Stripe, Inc. By providing payment information, you authorize us to charge your selected payment method for the applicable membership fee. You agree to Stripe’s Terms of Service at stripe.com/legal.
Membership benefits are not active until your identity has been verified by authorized Fun Pizza Kitchen staff. Purchasing a membership does not guarantee immediate access to all features.
Membership plans may automatically renew at the end of each billing period unless cancelled prior to the renewal date. You will be charged the then-current membership rate on your renewal date.
Promo codes may be applied at the time of purchase only. Promo codes cannot be applied retroactively and have no cash value.
Members may submit drink requests through the App while at a Fun Pizza Kitchen location. Drink requests are subject to:
FunKitchen LLC and Fun Pizza Kitchen management reserve the right to set, adjust, or enforce drink limits per member per visit. These limits exist for compliance with applicable alcohol service laws and for the safety of all guests.
Fun Pizza Kitchen staff reserves the right to refuse alcohol service at any time in accordance with Texas Alcoholic Beverage Commission (TABC) regulations and applicable law, including but not limited to refusal of service to anyone who appears intoxicated.
Submission of a drink request does not guarantee fulfillment. We are not liable for delays, refusals, or inability to fulfill drink orders due to staffing, inventory, or other operational reasons.

Violation of these conduct standards may result in immediate termination of your account without refund.
By submitting your selfie and ID photo, you consent to FunKitchen LLC staff reviewing this information for identity verification purposes. Staff may deny or revoke your membership verification if your identity cannot be confirmed or if information appears fraudulent.
All content within FPK Pass, including but not limited to the app design, logo, text, graphics, and software, is the property of FunKitchen LLC and is protected by U.S. copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content in the App without our express written permission.
Your use of FPK Pass is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNKITCHEN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless FunKitchen LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and governing law) will survive.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
We reserve the right to modify these Terms at any time. Material changes will be communicated via push notification or email. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
